PHOTO BOOTH SERVICE AGREEMENT & LIABILITY WAIVER
This Agreement is entered into by and between Bella Skye Events (“Consultant”) and the undersigned (“Client”).
1. SERVICES PROVIDED
Provider agrees to deliver and operate a Photo Booth at Client’s event as detailed in the attached invoice or event confirmation. Services include setup, operation, and breakdown of Photo Booth equipment.
2. PAYMENT TERMS
Full payment is due no later than 24 hours before the scheduled event. Payments are non-refundable under all circumstances, including cancellation or changes by the Client, venue, or other third parties.
3. LIABILITY WAIVER
Client understands and agrees that Bella Skye Events is not responsible for any injuries, accidents, or damages to persons or property that occur during or as a result of Photo Booth use, regardless of cause. Client voluntarily releases Bella Skye Events from any and all liability or claims arising from the event.
4. CLIENT RESPONSIBILITY FOR DAMAGES & THEFT
Client assumes full responsibility for the behavior of all guests and agrees to reimburse Bella Skye Events for the full cost of repair or replacement of any Photo Booth equipment that is damaged, lost, or stolen during the rental period.
5. RIGHT TO REFUSE SERVICE
Bella Skye Events reserves the right to refuse or discontinue service without refund if the event is deemed unsafe, inappropriate, or if guests pose a threat to staff or equipment.
6. VENUE ACCESS & SETUP REQUIREMENTS
Client agrees to provide:
• Access to venue at least 1 hour prior to event start
• A level space measuring at least 8x8 feet
• Access to a standard 110V power outlet within 10 feet
• Shelter from rain/sun if outdoors
Failure to meet these requirements may result in shortened service or cancellation without refund.
7. SERVICE & IDLE TIME
Photo Booth operation will occur during the timeframe agreed upon. Any idle time due to event delays, venue issues, or schedule changes is counted as part of the rental period. Extra time may be added at $85 /hour if available, payable on-site.
8. FORCE MAJEURE
Bella Skye Events is not liable for any failure to perform due to unforeseen events beyond its control, including but not limited to severe weather, illness, equipment failure, or government restrictions. In such cases, a credit may be issued at Provider’s discretion for a future event.
9. USE OF IMAGES
Unless Client provides a written request to opt out, Client grants Bella Skye Events the right to use any photos or videos taken by the Photo Booth for promotional purposes including online, print, or social media.
10. GUEST CONDUCT
Client agrees to monitor guest behavior. Bella Skye Events may terminate services without refund if guests are abusive, intoxicated, or mishandle equipment.
Retainer
An initial non-refundable retainer of $150 and a signed contract must be secured prior to any services being performed by Consultant. The non refundable retainer will go towards the final balance which is due 24 hrs prior to the scheduled date.
Contracted package
Includes all services described in selected package details reviewed and distributed to clients. Any additional services/products requested by the client incurred by consultant will be billed directly to client at cost. All services contracted cannot be deducted, but additional services can be added.
Responsibility
Consultant is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill consultant’s obligations.
Balloon Installation Responsibility
Consultant is not responsible for popped, deflated or damaged balloons post installation. Consultant is not responsible for disposing of balloons and encourages Client to review city guidelines on how to dispose latex balloons in an environmentally friendly way.
Costs
any purchased items on behalf of client for day of event or prior will be billed directly to client at cost of goods and mileage at $.52 per mile if extensive travel (beyond 25 miles) is required to be acquired.
Payment Schedule and Method
For your convenience, payments can be made online via HoneyBook.com using a valid credit card but a 3% fee will be applied. Otherwise, payment is to be made by cash or Venmo @BellaSkyeEvents last 4 of number 7867.
